Terms of Service & EULA

Please read these Terms of Service ("Terms") carefully before using Plant Pal ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. License Grant

Plant Pal is licensed, not sold, to you for personal, non-commercial use on your iOS device. This license does not grant you ownership of the App, only the right to use it under these Terms.

2. Subscription & Payment Terms

• Plant Pal offers a monthly auto-renewable subscription at $4.99/month with a 7-day free trial
• Payment will be charged to your Apple ID account upon confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel your subscription in your Apple ID account settings
• No refunds for unused portions of the subscription period
• Free trial period (if offered) will be forfeited when you purchase a subscription

3. SMS Messaging Terms

By providing your phone number, you consent to receive automated SMS messages from Plant Pal containing plant care reminders. Message and data rates may apply. You can opt out at any time by deleting your account or adjusting your settings.

4. User Content & Responsibilities

You are responsible for:

• Providing accurate phone number information
• All plant photos, names, and data you upload to the App
• Maintaining the confidentiality of your account
• All activity that occurs under your account

You agree not to:

• Use the App for any illegal purposes
• Upload content that violates intellectual property rights
• Attempt to disrupt or breach the security of the App
• Reverse engineer or attempt to extract the source code

5. Privacy & Data Collection

Your use of Plant Pal is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information including your phone number, plant photos, and care data. By using the App, you consent to our data practices as described in the Privacy Policy.

6. Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the App or its services
• Fail to pay subscription fees

You may delete your account at any time through the App settings, which will remove all your data from our systems.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that:

• The App will be error-free or uninterrupted
• SMS messages will always be delivered on time
• Plant care advice will prevent all plant health issues
• The App will meet your specific requirements

8. Limitation of Liability

Plant Pal and its creators shall not be liable for:

• Any damages arising from the use or inability to use the App
• Loss of data or plant-related damages
• Costs of SMS messages or data charges
• Missed plant care reminders due to technical issues

Your sole remedy for dissatisfaction with the App is to stop using it and cancel your subscription.

9. Third-Party Services

The App uses third-party services (Firebase, Twilio, Apple) that have their own terms and privacy policies. We are not responsible for the practices of these third-party services.

10. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. Material changes will be communicated through the App or via email.

11. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration on an individual basis (no class actions).

12. Indemnification

You agree to indemnify and hold harmless Plant Pal and its creators from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

13. Apple-Specific Terms

This license is between you and Plant Pal, not Apple. Apple is not responsible for the App or its content. Apple has no warranty obligations for the App. Apple is not responsible for addressing any claims you or third parties have relating to the App.
